KPM Sim Kit Terms of Service
Effective date: When first published at simkit.net
Last updated: October 14, 2026
1. About these Terms
These Terms of Service (“Terms”) govern your use of the KPM Sim Kit website at simkit.net, our desktop application, dashboard and overlay tools, community features, and related services that refer to these Terms (together, the “Service”).
The Service is operated by Kyle McDonald, an individual based in Illinois, United States, operating under the KPM Sim Kit name (“KPM Sim Kit,” “we,” “us,” or “our”). References to KPM Sim Kit in these Terms identify that individual as the operator of the Service.
By downloading, installing, or using the Service after these Terms have been made available to you, you agree to these Terms. Read them before using the Service. If you do not agree, do not download, install, or use the Service. If you use the Service on behalf of an organization, you confirm that you have authority to bind it. This notice does not waive any right or protection that applicable law gives you.
Our Privacy Policy explains how we handle personal information. Acceptance of these Terms is not consent to optional marketing, tracking, or any other processing that requires separate consent.
2. Eligibility and accounts
You must be at least 18 years old to use the Service. You must also be able to enter a binding agreement where you live. We do not offer accounts to minors. Purchases must be made by an adult with authority to use the payment method.
You must provide accurate account information and keep it current. Protect your credentials, authentication links, and access tokens, and promptly contact us through the contact form if you believe your account has been compromised. You are responsible for your use of the Service and for activity you authorize through your account, but not automatically for unauthorized activity that applicable law makes our responsibility.
Do not sell, rent, or transfer an account or paid entitlement without our permission. A plan may have usage or device limits, which will be disclosed before purchase.
3. Using the software
Subject to these Terms and the limits of your plan, we grant you a limited, non-exclusive, non-transferable license to install and use the software on devices you own or control for simulation activities, including team, coaching, and league use. These uses follow the same account, device, and plan limits disclosed before purchase. This permission does not allow you to share account credentials, transfer paid entitlements, or resell the application.
You may display your dashboards and overlays in screenshots, recorded videos, and livestreams, including monetized streams, provided you have the necessary rights to any third-party material you include. This permission covers only rights that KPM Sim Kit is entitled to grant. It does not replace any permission required for simulator footage, third-party logos, artwork, music, or other materials, or override an applicable simulator broadcast policy. It does not allow you to resell or redistribute the application, access credentials, paid features, or our standalone design assets.
Open-source software and other third-party materials may have separate licenses. Those licenses govern the relevant materials and are not restricted by these Terms where they grant additional rights.
You are responsible for compatible hardware, operating systems, simulator access, and any separately required third-party software or subscriptions. We do not promise compatibility with every device, simulator version, or integration.
The software may check for, download, and install updates as described in its settings and documentation. Updates may change functionality or require supported versions of related software. We will not use an update to impose a new paid subscription without your agreement. Sections 8 and 12 explain protections concerning changes to paid services.
Connectivity and account verification
Internet access is needed to sign in, refresh account permissions, manage billing, use Community, and check for updates. Simulator dashboards process live data on your computer. An existing session may continue until its current authorization expires, but we do not promise a fixed offline grace period or indefinite offline access to paid features. A connection may be required again after a restart or when authorization expires.
4. Simulation use and third-party services
The Service is intended for simulated racing and entertainment, not for operating a real vehicle or providing safety-critical information.
Telemetry, timing, fuel estimates, relative positions, spotter information, flags, and other outputs depend on source data, configuration, and software operation. They may be unavailable, delayed, or inaccurate. Check important information against the simulator and relevant competition rules. We do not guarantee race results, lap-time improvements, uninterrupted displays, or eligibility under a league’s rules.
Simulator access and data
Features that connect to iRacing or another simulator require lawful access to that simulator and any separately required subscriptions, content, or permissions. A purchase from KPM Sim Kit does not include an iRacing or other simulator subscription, vehicle or track license, or a license to redistribute third-party data or assets.
You must comply with the terms applicable to your use of third-party simulators and interfaces. These Terms do not authorize access-control bypasses, unauthorized extraction, or uses prohibited by an applicable third-party license. Nothing in these Terms limits rights that applicable law makes non-waivable. Our Privacy Policy, rather than this intellectual-property provision, explains how personal information in simulator data is handled.
Third-party names, trademarks, and materials
Unless we expressly state otherwise, KPM Sim Kit is an independent product and is not affiliated with, sponsored by, endorsed by, or officially approved by iRacing, SimHub, or any vehicle manufacturer, hardware manufacturer, circuit owner, racing series, or other third party referenced in the Service.
References to third-party names and marks identify products, compatibility, or simulation context; they do not by themselves establish an official relationship. iRacing is a trademark of iRacing.com Motorsport Simulations, LLC. Other third-party names, logos, and marks belong to their respective owners.
Any intellectual-property rights in third-party artwork, vehicle and track images, logos, datasets, fonts, or other materials remain with their respective rights holders. Displaying, importing, caching, or making an item available through the Service does not by itself transfer ownership or grant a separate right to extract, redistribute, sublicense, or commercially exploit that material. Any such use must be permitted by the applicable rights holder, license, or law.
Where separate third-party license terms or attribution notices apply, they govern the relevant material. Nothing in these Terms overrides those terms or restricts rights they or applicable law grant. See Third-Party Notices for the applicable notices.
Your use of third-party products and services is governed by their own terms. We do not control them, and changes to them can affect integrations. This does not limit any mandatory rights you have against us for the Service we provide.
If you connect YouTube, Sim Kit uses YouTube API Services. By using those features, you also agree to the YouTube Terms of Service. You must review and accept the Privacy Policy before accessing the connected YouTube feature. This acknowledgment does not authorize unrelated processing or optional analytics. Google's handling of information is described in the Google Privacy Policy.
5. Acceptable use
You must not use the Service to violate the law, infringe another person’s rights, harass others, publish private information without permission, or upload unlawful or malicious material.
You must not bypass payment or access controls, access accounts or systems without authorization, interfere with the Service, or use automated activity that materially disrupts it. Ordinary use of supported integrations, exports, and documented interfaces is permitted.
Do not copy, resell, or commercially redistribute our software or paid materials except as expressly permitted. Do not reverse engineer or circumvent technical protections except where applicable law or an applicable open-source license permits it. This restriction does not prohibit lawful interoperability work or other rights that cannot be waived.
If you discover a security issue, report it through the contact form. Do not access other people’s data or disrupt the Service while investigating.
6. Your content and community sharing
Ownership and permission to operate the Service
You retain the rights you have in the dashboards, widgets, themes, overlay designs, images, text, and other materials you create or submit (“Your Content”). These Terms do not transfer ownership of Your Content to us.
To the extent necessary to provide the features you use, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, and display Your Content. We may allow service providers acting on our behalf to perform those activities for us. This license is limited to operating, maintaining, and delivering the Service. It does not, by itself, authorize us to use Your Content in advertisements or promotional campaigns. We will request separate permission for that use unless you have already granted the relevant permission under a separate agreement.
You must have the rights needed to submit Your Content and to grant the permissions associated with the sharing choices you make. In particular, do not publish images, fonts, logos, or other assets you are not authorized to share.
Publishing to Community
When you choose to publish an item to Community, you authorize us to make the selected content, associated assets, and listing information available to other users through the Service.
Community releases use CC0 1.0 Universal. By choosing to publish a release, you apply CC0 to the copyright and related rights you control in that release under these Terms and confirm that you have the rights to share all included content. CC0 permits copying, modification, redistribution, and commercial use, including resale and promotional use, without asking you for permission or providing attribution. Its waiver and fallback license cannot be revoked to the extent stated in CC0. Removing a listing does not withdraw rights validly granted for releases already shared.
You must be entitled to apply CC0 to the material you upload. Do not include a restricted asset or someone else's work merely because it is available to download. Our publishing flow does not provide a separate license-exclusion mechanism for individual assets; omit material whose terms conflict with the CC0 grant. CC0 does not grant rights you do not hold, waive trademark or patent rights, or clear another person's privacy or publicity rights. Our commitment to request separate permission before using your content in our promotions remains a commitment by us; it does not narrow rights other recipients validly receive under CC0.
Choosing a font already supplied by Sim Kit references that font; it does not upload or dedicate the font software under CC0. Your dedication covers rights you control in your design. Uploaded third-party asset files must still meet the publishing requirements above.
These permissions apply only to rights you control. Third-party license restrictions continue to apply, including restrictions on included manufacturer logos, simulator artwork, fonts, and datasets. A community-content license does not grant rights in those materials that the contributor does not hold. Do not attach licensing terms to an item that conflict with rights you do not have.
Making an item private or removing its public listing stops its distribution from that listing. It does not automatically remove copies previously obtained by other users or revoke CC0 rights validly granted in an earlier release. Those rights do not depend on keeping a Sim Kit account or continued access to the application. Separate third-party rights and applicable law still apply.
Our license ends when the relevant content has been removed from our active systems, except to the extent reasonably necessary for restricted backups, legal obligations, and administering uses authorized before removal. This provision does not override anyone’s rights under applicable privacy law.
Optional track map contributions
If you choose to share track observations, you give us permission to use those observations to evaluate, prepare and distribute shared track map corrections. Turning sharing off stops future contributions. Corrections already published, and copies others already obtained, may remain available. This permission does not transfer your ownership of your recordings or give us permission to publish their full contents. Third-party rights and applicable privacy rights continue to apply. Sharing is optional and separate from Usage analytics and Community publication.
Moderation and complaints
We may remove or restrict content that violates these Terms, infringes rights, or creates a material security or legal risk. Where appropriate and lawful, we will provide an explanation and an opportunity to contact us about the decision.
Send content or intellectual-property complaints through the contact form, with your contact information, the item’s location, an explanation of the issue, and information supporting your authority to complain. We may request more information to evaluate the report. This reporting process does not limit remedies available under applicable law.
7. Free features, paid plans, and trials
Some features may be free and others may require payment. The price, currency, billing interval, included features, applicable taxes, and any trial or promotional conditions will be shown before you complete a purchase.
A subscription renews automatically only when the offer clearly states that it is recurring and you authorize recurring charges during checkout. For such subscriptions, you authorize the disclosed recurring charges until you cancel. A free account or software download alone does not authorize a charge.
If a trial converts into a paid subscription, we will disclose its length, when the first charge will occur, the amount and billing interval, and how to cancel before you enroll. We will obtain the required authorization and provide notices required by applicable law.
You must use an authorized payment method and keep billing information current. We use Stripe for payments, as described in our Privacy Policy and at checkout. If a payment fails, we may contact you and suspend affected paid features after reasonable notice, subject to applicable law.
8. Cancellation, refunds, and price changes
Canceling a subscription
You can cancel recurring billing through your account at simkit.net/dashboard: choose Manage subscription, then cancel in the Stripe customer portal before your next renewal charge. There is no additional cancellation fee. If that method is unavailable, use the contact form for help. Cancellation takes effect for future renewals, and access normally continues until the end of the paid billing period unless you request an earlier end or applicable law requires a different result.
Uninstalling the application or stopping use does not, by itself, cancel a subscription. When you request deletion of your account, we will also cancel future recurring charges for subscriptions we bill directly. We will explain any separate steps needed for subscriptions billed by another seller.
Plan changes and existing designs
Before you confirm a plan or billing-interval change, the subscription-management page will show its effective date and any charge or credit. Changes that lower your paid entitlement normally take effect at the next renewal. An immediate upgrade may include a prorated charge only when it is disclosed before confirmation. We do not promise a cash refund for a mid-period downgrade except under the refund policy below or applicable law.
Canceling or losing paid access does not transfer ownership of your designs to us. Your saved local files remain yours. Paid features may stop when the paid period ends; you may continue using available free features and keep previously exported files. We will not delete local designs merely because you cancel. Before your paid access ends, export or back up designs you want to keep. Third-party and Community licenses continue to apply to their materials.
Refunds
For the first charge you pay for a Sim Kit subscription, you may request a full refund by submitting a request within 14 calendar days after that charge through the contact form, providing the email address associated with your account. The date you submit the request determines eligibility; processing time does not shorten the request period. The refund ends the refunded paid access and cancels future renewals. Renewal charges are normally non-refundable, but we will review duplicate charges, billing mistakes, and requests involving a material service failure. Where we approve a refund, we return it to the original payment method; your payment provider determines when it appears. Any refund or other remedy required by law remains available.
Nothing in these Terms excludes a refund, cancellation, withdrawal, repair, replacement, or other remedy required by applicable consumer law. Starting a download or using the Service does not, by itself, waive a statutory withdrawal right; any lawful waiver requires the separate process and information applicable law requires.
Changes to recurring prices
We will give at least 30 days’ advance notice of an increase to an existing subscription’s recurring price, or longer notice where required by law. The new price will apply no earlier than a renewal after that notice period. You can cancel before it applies. Where the law requires affirmative consent, we will obtain it before charging the new price.
9. Our intellectual property and feedback
Apart from Your Content and separately licensed third-party materials, we and our licensors retain ownership of the Service, including its software, branding, and original designs. You receive only the rights expressly granted by these Terms or an applicable separate license.
If you voluntarily provide suggestions or feedback, you allow us to use them to improve the Service without an obligation to compensate you. This does not transfer ownership of Your Content or permit us to disregard the Privacy Policy. Do not provide feedback containing confidential information that you are not authorized to disclose.
10. Privacy and local content
Our Privacy Policy describes personal information processed in connection with the Service, including local processing, online storage, connected streaming accounts, and our use of WorkOS, Stripe, Cloudflare, Knock, and PostHog. Acceptance of these Terms does not substitute for separately required consent to analytics or another optional use.
Keep appropriate backups of important local files and exported designs. Cloud storage or restoration is included only where expressly offered as a feature. Nothing in this section excuses us from responsibilities we expressly undertake or that applicable law imposes.
Cloud backup
Where private cloud backup is offered to eligible Alpha or Pro accounts, we show an in-app notice before automatic uploads begin. Backup saves completed local configurations after editing stops. You can turn automatic backup off in Profiles & backups. Limits and status are shown in the app; a local save does not mean a cloud backup has finished. Keep an independent copy of important files.
You choose when to restore a recovery point. Backup does not automatically replace configurations on other computers. Retained backups remain available for recovery or export for 90 days after plan eligibility ends, as described in the Privacy Policy. Turning backup off does not delete existing history. Delete cloud backups removes that history and stops new backups while removal finishes. Local and exported copies remain under your control. These limits do not reduce responsibilities we expressly undertake or that applicable law imposes.
11. Suspension and termination
You may stop using the Service at any time and request account deletion through the contact form or through an available account-deletion feature. Subscription cancellation is addressed in Section 8.
We may suspend or terminate access for a material breach of these Terms, unpaid charges after reasonable notice, a serious security risk, or a legal requirement. Where practicable, we will give notice and an opportunity to remedy a breach before terminating. Immediate action may be necessary to prevent harm or comply with law.
If we discontinue a paid service or terminate your access for reasons other than your material breach, we will provide reasonable notice and a proportionate refund of prepaid fees for the unavailable remainder of the paid period. Mandatory consumer remedies also remain available.
After termination, you must stop using features for which your permission has ended. We will handle retained personal information under the Privacy Policy. Sections concerning accrued payment obligations, ownership, existing community-content permissions, limitations of liability, and disputes survive to the extent needed to give them effect.
12. Availability and changes to the Service
We may maintain, improve, or change the Service. We will provide reasonable notice of material changes that negatively affect existing users where practicable. We will not materially reduce the core features of a prepaid plan during its paid period without offering an appropriate remedy, which may include continued access or cancellation and a proportionate refund.
Features described as experimental, preview, or beta may change or be discontinued. Such labels do not remove mandatory consumer rights or justify withholding a paid feature we have committed to provide.
13. Disclaimers
To the fullest extent permitted by law, and except for express commitments in these Terms or at purchase, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement only where those disclaimers are lawful.
We do not guarantee that the Service will be uninterrupted, error-free, or suitable for every setup. These disclaimers do not exclude statutory warranties or our obligation to provide the Service with the standard of care required by applicable law.
14. Limits on liability
To the fullest extent permitted by law, neither KPM Sim Kit nor its personnel or suppliers will be liable under these Terms for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from the Service.
Subject to the exceptions below, our total aggregate liability arising from the Service will not exceed the greater of US $100 or the amount you paid us for the Service during the 12 months immediately before the event giving rise to the claim.
These exclusions and limits do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not allow us to exclude or limit. They also do not restrict mandatory consumer remedies. If local law requires a different limit, that law controls.
15. Governing law and disputes
These Terms are governed by the laws of Illinois, United States, excluding its conflict-of-laws rules, except that you retain any mandatory protections of the law where you habitually reside.
Subject to those mandatory rights, disputes concerning these Terms may be brought in state or federal courts in Illinois that have jurisdiction over the dispute. Nothing here prevents you from bringing a claim in a court available to you under mandatory consumer law or an applicable small-claims procedure.
You may use the contact form to try to resolve a concern informally. Doing so is encouraged but is not a condition that limits a statutory right or filing deadline. These Terms do not impose mandatory arbitration or a class-action waiver.
16. Changes to these Terms
We may update these Terms. We will publish the revised version and update the date above. For material changes, we will give reasonable advance notice through the Service or appropriate account communications, except where a faster change is needed for legal or urgent security reasons.
Where required by law or where the nature of a change requires a new agreement, we will ask you to accept the revised Terms. Changes will not retroactively alter accrued claims. If you decline a materially adverse change during a prepaid period, we will offer continued access under the existing terms for that period or an appropriate cancellation and proportionate refund option.
17. General provisions and contact
These Terms and any additional terms expressly presented and accepted for a specific feature form the agreement concerning the Service. A provision that cannot lawfully be enforced will apply only to the extent permitted, and the remaining provisions will continue in effect. Failure to enforce a provision immediately is not a waiver.
We may transfer this agreement in connection with a merger, acquisition, or sale of the Service, provided the transfer does not reduce your mandatory rights. We will provide notice where required. You may not transfer your agreement without our consent, except where applicable law allows it.
